Sarah is a commercial litigator who works on corporate and commercial disputes, fraud and asset recovery and aviation law matters. She has also acted in arbitrations involving disputes arising from commercial contracts, and oil & gas matters.

She has advised and assisted in proceedings involving complex contractual disputes, shareholders’ disputes and the recovery of funds in cross-border disputes.

Sarah undertook the Bachelor of Laws (LL.B.), the Bar Professional Training Course (BPTC), and Master of Laws in BPTC (LL.M.) from Cardiff University and was awarded with a Distinction in her Master of Laws (LL.M.) Dissertation on Company Law on minority shareholders at Cardiff University. She is a Barrister-at-Law (Middle Temple).

Key Practice Areas
International Arbitration
  • Acted as a junior counsel in successfully obtaining an arbitral award rendered under the Expedited Procedure of the Singapore International Arbitration Centre Rules for an asset valued at approximately SGD6 million, and successfully registering the award as a judgment in Malaysia: see Super Sea Cable Networks Pte Ltd v Sacofa Sdn Bhd [2023] MLJU 2244.
  • Assisted and collaborated with Singapore counsel in successfully resisting a setting aside application before the Singapore High Court: see Sacofa Sdn Bhd v Super Sea Cable Networks Pte Ltd. [2024] SGHC 54.
  • Advised and acted for a Thailand-based company and charterers of a shipping vessel in two related International Chamber of Commerce (ICC) and London Maritime Arbitrators Association (LMAA) arbitration proceedings with at least USD65 million at stake. These disputes resulted in a global settlement following a challenging negotiation process complicated by sanctions imposed by the United States.
Commercial Litigation
  • Acted as lead counsel in successfully obtaining a striking out order: see Altratec Sdn Bhd v Thong Young Koon & Ors [2023] MLJU 2175.
  • Acted as a junior counsel in successfully resisting an application for a defence to be struck out on the ground of non-compliance with discovery order: see Attitude Models & Production Sdn Bhd v Jade Eservices Malaysia Sdn Bhd [2022] MLJU 958. This decision was upheld on appeal.
  • Advised a subsidiary of the Government of Malaysia in a contractual dispute with over RM25 million at stake.
  • Acted as a junior counsel for a food ingredient manufacturer in Malaysia and the beneficiaries of the disputed policy in a post-trial appeal concerning a contractual and tortious claim against an insurance broker, involving approximately RM6 million.
  • Advising and acting as a junior counsel for an e-commerce company in Malaysia in defending a breach of contract claim involving approximately RM3 million.
  • Advised and acted for an aggrieved shareholder in bringing an oppression action.
Fraud and Asset Recovery
  • Advising and acting for an international trading house in pursuing a fraud and conspiracy claim for RM179 million against 20 defendants, and a successful asset recovery of approximately RM8 million to-date.
  • Acted as lead counsel in successfully obtaining leave from the winding-up court to commence execution proceedings against a wound-up company.
  • Assisted in advising a wholly-owned subsidiary of a multinational corporation, and secured judgment for over RM14 million and a post-judgment Mareva injunction against its former employee for misappropriation of funds.
  • Advised and acted as a junior counsel for an American private company in obtaining a High Court judgment for over USD7.55 million in a fraud claim.
  • Acted as co-counsel in securing a judgment against former directors of a company for their misappropriation of company funds.
Regulatory Enforcement
  • Advising and acting for the Malaysian securities regulator in resisting judicial review application(s) filed by public-listed companies.
  • Acted as a junior counsel for the Malaysian securities regulator in successfully resisting a judicial review challenge through a preliminary objection. The matter is now pending before the Court of Appeal.
  • Advised and acted for the Malaysian securities regulator in pursuing a statutory claim under section 360 of the Capital Markets and Services Act 2007 against companies and management personnel for their direct and/or indirect contributions to a company assuming the role of controller of a Capital Market Services Licence holder.
Aviation Law Disputes
  • Acting for a US-based aircraft and aviation investment firm against Malaysia-based lessees for the recovery of approximately RM36.4 million arising from breach of aircraft leasing agreements.
