Muhammad Akhmal Amaluddin Bin Mat Aris
Associate
Akhmal is a commercial litigator with substantial experience in administrative law proceedings, having represented both private litigants and public authorities. He has been involved in cases spanning across subject matters such as intellectual property, social security law, and constitutional law.
In respect of commercial matters, he had assisted in proceedings for breach of a Bai’ Bithaman Ajil transaction and the winding-up of the judgment debtor.
With regard to fraud and asset recovery, he has assisted in the coordinating the execution of a Mareva Injunction and Interim Preservation of Property Order spanning five states in Peninsular Malaysia.
He also has experience in international arbitration and the enforcement of foreign judgments, having assisted in appellate proceedings to determine the validity of enforcing a foreign enforcement judgment (founded upon an arbitral award) under the Reciprocal Enforcement of Judgments Act 1958.
He graduated from the University of Malaya in 2023.
International Arbitration
- Assisted in a successful appeal to the Federal Court for the registration and enforcement of an English High Court Judgment, founded upon a London Arbitral Award, pursuant to the Reciprocal Enforcement of Judgments Act 1958.
Administrative Law
- Assisted counsel in acting for a biopharmaceutical company in an appeal against the decision of the Registrar of Patents dismissing an application for an extension of time and reinstatement of a patent application. Thereafter, on appeal, assisted counsel to defend the High Court’s judgment at the Court of Appeal.
- Assisted counsel in acting for the Social Security Organisation in a successful appeal against the decision of the Social Security Appellate Board concerning an application for temporary disablement benefits.
- Assisted in representing an oil palm plantation in proceedings challenging the constitutionality of certain provisions in the Windfall Profit Levy Act 1998, the Windfall Profit Levy (Validation) Act 2023, the legality of subsidiary legislation and executive actions taken pursuant to the statute and subsidiary legislation.
- Assisted in representing prominent oil and gas companies in 11 appeals against the decisions of a local authority under the Local Government Act 1976. Thereafter, assisted in securing the settlement of all 11 appeals.
- Assisted in representing an online securities broker in judicial review proceedings to challenge the decision of the SIDREC Appeals Committee.
- Assisted in representing a Malaysian capital markets regulator in judicial review proceedings to defend its decisions against directors of a de-listed company.
Commercial and Corporate Litigation
- Assisted in representing a foreign bank to enforce the terms of a settlement agreement, particularly the payment of owed sums.
- Assisted in representing a local financial institution in appellate and execution proceedings to recover monies paid under a Bai’ Bithaman Ajil transaction.
Fraud and Asset Recovery
- Assisted in representing a prominent domestic gold jewelry supplier in a case of, among others, fraud, and breach of trust, to recover its gold jewelry. Assisted in taking interim measures to preserve assets include a Mareva Injunction and Interim Preservation of Property Order, and enforcement of the same by way of committal proceedings.
