Annabel Tan Sher Maye
Senior Associate
Annabel is a commercial litigator. Her practice focuses on oil and gas disputes, competition law, as well as fraud and asset recovery. She has been involved in a variety of contractual disputes involving local and international banks, and within the automotive industry and the construction industry.
In oil and gas disputes, Annabel has been involved in both litigation and arbitration proceedings, representing one of the largest multinational oil and gas corporations as well as Malaysia’s main oil and gas exploration and production entity. She has experience in both upstream and downstream disputes.
She is also involved in competition law disputes. She is a part of the team at the Federal Court defending the first and subsequent decisions issued by the Malaysian Competition Commission.
Annabel is also currently involved in fraud and asset recovery matters pursuing the recovery of misappropriated funds. Her scope encompasses both recovery of monies in the civil suit as well as liaising with the authorities in relation to the criminal proceedings.
Annabel graduated with a LL.B. (Hons) from University of the West of England and is a Barrister-at-Law (Inner Temple). She joined Lim Chee Wee Partnership and was promoted to senior associate in August 2021.
Key Practice Areas
Oil & Gas, and Energy Disputes
- Acted as junior counsel for a multinational oil and gas corporation in a dispute involving haulage services.
- Assisted counsel in successfully resisting an application for injunction in aid of arbitration in an oil and gas dispute, involving an unconditional on-demand bank guarantee of USD20 million.
- Assisted counsel in acting for a multinational oil and gas corporation in relation to enforcement of and resisting setting aside of an arbitration award.
- Advised one of the largest utility companies in Southeast Asia on various issues including licencing, power purchase and seawater abstraction charges.
Competition Law Litigation
- Currently assisting counsel in challenging the Court of Appeal’s decision, which set aside the first ever decision by the Malaysia Competition Commission (“MyCC”) under the Competition Act 2010, in imposing a fine of RM10 million each against Malaysian Airlines Berhad and AirAsia Berhad for entering into an alleged anti-competitive agreement.
- Currently assisting counsel in challenging the Court of Appeal’s decision, which set aside MyCC’s decision in imposing a fine of RM86 million on Grab for an alleged abuse of dominant position.
Fraud and Asset Recovery
- Assisted counsel in recovering assets in respect of funds misappropriated by an employee.
Commercial Litigation and Arbitration
- Acted as counsel for a UAE based trading company in respect of a contractual dispute.
- Acted as junior counsel in trial in respect of a trademark and licencing disputes.
- Acted as counsel for and advised one of the world’s largest Islamic banks on disputes involving loan facilities.
- Acted as counsel for recovery of debts for local and international banks, as well as a multinational oil and gas corporation.
- Assisted counsel for a multinational oil and gas corporation in an arbitration proceeding relating to a downstream oil and gas dispute.
- Assisted counsel in acting for an international renal care provider in Malaysia on dispute involving foreign equity participation policy.
- Assisted counsel and advised on disputes involving Hire-Purchase Act 1967, Sale of Goods Act 1957, and Consumer Protection Act 1999 for one of the world’s largest automotive corporations.
- Advised a subsidiary of a Japanese multinational conglomerate company on construction disputes.
