Court of Appeal Dismisses MyEG Appeal against MyCC Penalty

3 May 2021 – As covered by The Edge Malaysia, the Court of Appeal upheld the High Court's decision in dismissing MyEG's Judicial Review Application against the decision of the Competition Appeal Tribunal (CAT) made in December 2017.

The CAT upheld the decision of the Malaysian Competition Commission (MyCC) which found that MyEG had abused its dominant position by imposing different conditions in equivalent transactions in the purchase of mandatory insurances for the renewal of Pas Lawatan (Kerja Sementara) for foreign workers.

This decision represents the first Court of Appeal decision in relation to an infringement of abuse of dominant position.

MyCC was represented by Dato' Lim Chee Wee, Kwan Will Sen and Muayyad Khairulmaini.
